Acceptance of Terms

Welcome to Table Alert (the "Service"), operated by Hospitality Labs, a company registered in the Netherlands ("Hospitality Labs," "we," "us," or "our").

These Terms of Service (these "Terms") constitute a legally binding agreement between you ("you" or "User") and Hospitality Labs governing your access to and use of the Service.

By creating an account, subscribing to, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.


1. Definitions

"Account" means your registered account on the Service.

"Alert" means a notification sent by the Service to inform you of detected availability at a restaurant you are monitoring.

"Content" means any text, data, information, graphics, or other materials.

"Monitored Restaurant" means a restaurant you have selected within the Service for reservation availability monitoring.

"Service" means the Table Alert platform, including the website at tablealert.app, associated applications, APIs, email notifications, and all related features and functionality.

"Subscription Plan" means the pricing plan and feature tier you have selected for your Account.


2. Description of Service

Table Alert is a restaurant reservation availability monitoring and alert service. The Service monitors selected third-party restaurant reservation platforms for availability changes and sends you Alerts when availability is detected at your Monitored Restaurants.

Important disclaimers about the Service:

  • No guaranteed reservations. The Service monitors and notifies you of detected availability. We do not make, hold, or guarantee reservations on your behalf.
  • Third-party platforms. The Service relies on information obtained from third-party restaurant reservation platforms. We are not affiliated with, endorsed by, or partnered with any restaurant or reservation platform unless explicitly stated.
  • No dining or hospitality services. Hospitality Labs does not operate restaurants and does not provide dining, food, or hospitality services of any kind.
  • Availability may change. Restaurant availability is dynamic and may change between the time an Alert is sent and the time you attempt to make a reservation.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is designed for individual, personal use. Commercial use (concierge services, reservation brokers, etc.) is prohibited without prior written approval.


4. Account Registration and Security

To use the Service, you must create an Account by providing your email address and other requested information. You agree to provide accurate, current, and complete information.

You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Each individual may maintain only one Account.


5. Subscription Plans, Credits and Billing

Plans and Pricing. The Service is available under various Subscription Plans as described on our pricing page. Features, limitations, and pricing may vary by plan.

Restaurant Credits. As an alternative to a recurring subscription, you may purchase one or more restaurant credits as a one-time payment. Each credit entitles you to monitor one restaurant. Credits are charged once through Stripe with no automatic renewal. A credit is consumed when it is assigned to a restaurant watch, and does not expire while your Account remains active. Credits are non-refundable except as required by applicable law. If your Account is deleted or terminated for breach of these Terms (including the Fair Use Policy in Section 9), any unused credits are forfeited without refund.

Billing. Paid subscriptions are billed in advance on a recurring basis (monthly or annually). By subscribing, you authorise Hospitality Labs and Stripe, Inc. to charge the applicable fees to your payment method.

Automatic Renewal. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Price Changes. We may adjust pricing with at least thirty (30) days' notice. You may cancel before a price change takes effect.

Taxes. All fees are exclusive of applicable taxes (including VAT). You are responsible for all taxes associated with your subscription.

Refunds. All fees are non-refundable except as required by applicable law. If you cancel, you retain access until the end of your current billing period.


6. License and Restrictions

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, non-commercial purposes.

You shall not: copy, modify, or create derivative works of the Service; reverse engineer or decompile the Service; sell, sublicense, or distribute access to the Service; use automated means to access the Service; interfere with the Service's infrastructure; or use the Service to build a competing product.


7. Intellectual Property

The Service, including all software, algorithms, design, and Content, is owned by Hospitality Labs or its licensors. "Table Alert" and "Hospitality Labs" are trademarks of Hospitality Labs.


8. Acceptable Use

You agree not to use the Service to violate any applicable law, harass or threaten any person, transmit malware, impersonate another person, or interfere with the operation of the Service.


9. Fair Use Policy

Table Alert is designed as a personal tool for individuals seeking to dine at hard-to-book restaurants. You must genuinely intend to dine at every restaurant you monitor.

Search parameters must reflect real dining intent. The date ranges, party sizes, times and other search parameters you configure must reflect the dates and parameters you would actually book if availability appeared. You must not configure artificially wide search ranges to collect information you do not intend to act on.

Alerts are actionable, not informational. Each Alert you receive should be treated as an actionable booking attempt: when an Alert is delivered, you are expected to try to reserve the slot. We understand that you will not always succeed — other users or the public may book faster — and failing to book a slot despite a genuine attempt is not a breach of this policy. What is a breach is routinely ignoring Alerts or using the Service as a passive information feed.

Prohibited uses include using the Service on behalf of third parties (concierge services, brokers, etc.), operating multiple accounts for multiple clients, and commercially exploiting information obtained through the Service.

We reserve the right to suspend or terminate Accounts that violate this Fair Use Policy without refund.

9.1 Automatic Pausing of Wide-Availability Watches

If a restaurant you are monitoring consistently shows wide availability within your configured search range, the Service may automatically pause that watch and notify you by email. This reflects the Fair Use expectation above: if a restaurant is easy to book across your whole search range, Alerts for it add no value and suggest the restaurant is not actually hard-to-book for your parameters.

An automatically paused watch can be resumed at any time from your dashboard, typically after you narrow your search range to dates you genuinely want to dine on. Automatic pausing is a product protection, not a penalty, and is distinct from a Fair Use suspension or termination under this Section 9.


10. Communications and Marketing Emails

Transactional emails (required). By creating an Account you agree to receive transactional emails that are essential to operating the Service, including availability alerts for your Monitored Restaurants, payment receipts, password resets, security notices, and legal or account updates. These emails cannot be opted out of while your Account is active, because they are necessary to provide the Service you have subscribed to.

Marketing emails (optional, opt-in). With your separate consent, we may send you newsletter emails, product-update emails, and occasional insider content (such as restaurant-availability statistics and platform news). You may opt in via a checkbox during signup or by subscribing on our website, and you may opt out at any time via the one-click unsubscribe link in every marketing email or by emailing info@tablealert.app. Opting out of marketing emails has no effect on transactional emails or on your subscription.

Signup-reminder emails. If you start creating an Account but do not complete checkout, we may send you up to four short reminder emails over a maximum of fourteen days to help you finish signing up. This sequence stops automatically when you complete checkout or when you click the unsubscribe link. Full details, including the legal basis, are in Section 4.4 of our Privacy Policy.


11. Termination and Suspension

By You: You may cancel your subscription and close your Account at any time through your Account settings or by contacting us.

By Us: We may suspend or terminate your Account if you breach these Terms, fail to pay fees, or if required by law. If we discontinue the Service, we will provide at least thirty (30) days' notice.


12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that Alerts will be accurate or delivered in a timely manner.


13. Limitation of Liability

To the maximum extent permitted by law, Hospitality Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the fees paid by you during the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.


14. Indemnification

You agree to indemnify and hold harmless Hospitality Labs from claims arising out of your use of the Service, breach of these Terms, or your interactions with restaurants or reservation platforms.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the courts in Amsterdam, subject to any mandatory rules granting jurisdiction to the courts of your place of residence.

If you are a consumer within the EU, you may also use the EU Online Dispute Resolution platform.


16. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated at least thirty (30) days before they take effect. Your continued use of the Service constitutes acceptance of the modified Terms.


17. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hospitality Labs. If any provision is found to be invalid, the remaining provisions continue in full force. No failure to enforce a right constitutes a waiver. You may not assign your rights without our consent.
